PRIVACY POLICY

Effective From August 23, 2014

The following Privacy Policy governs the online information collection practices of 28Factors.com (“we” or “us”). Specifically, it outlines the types of information that we gather about you while you are using any of the websites owned/operated by us (the “Sites”), and the ways in which we use this information. This Privacy Policy, including our children’s privacy statement, does not apply to any information you may provide to us or that we may collect offline and/or through other means (for example, at a live event, via telephone, or through the mail).

Please read this Privacy Policy carefully. By visiting and using the Sites, you agree that your use of our Sites, and any dispute over privacy, is governed by this Privacy Policy.

 

1. INTRODUCTION

1.1. PURPOSE OF POLICY

28Factors.com (“us,” “we,” or “Company”) is committed to respecting the privacy rights of its customers, visitors, and other users of the websites owned/operated by us (the “Sites”). We created this Website Privacy Policy (this “Policy”) to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices and the protection of privacy. This Policy is only applicable to the Sites, and not to any other websites that you may be able to access from the Sites, each of which may have data collection and use practices and policies that differ materially from this Policy.

1.2. CHILDREN’S PRIVACY STATEMENT

We understand and are committed to respecting the sensitive nature of children’s privacy online. This section explains our practices with respect to the online collection and use of personal information from children under the age of thirteen, and provides important information regarding their rights with respect to such information.

  • In general, our Sites are not directed at children under the age of thirteen and we do NOT knowingly collect personally identifiable information from children under the age of thirteen as part of the Sites. If we become aware that we have inadvertently received personally identifiable information from a user under the age of thirteen as part of the Sites, we will delete such information from our records.
  • Because we do not collect any personally identifiable information from children under the age of thirteen as part of the Sites, we also do NOT knowingly distribute such information to third parties.
  • Because we do not collect any personally identifiable information from children under the age of thirteen as part of the Sites, we do NOT condition the participation of a child under thirteen in the Sites’ online activities on providing personally identifiable information.
  • Where a Site owned / operated by us is targeted towards children under the age of thirteen, an addendum to this privacy policy shall be posted on the respective Site.

 

2. INFORMATION COLLECTION PRACTICES

2.1. WHAT INFORMATION DOES COMPANY COLLECT?

(a) VOLUNTARY INFORMATION. We may collect and store personal or other information that you voluntarily supply to us online while using the Sites (e.g., while on the Sites or in responding via email to a feature provided on the Sites). 28Factors.com only contacts individuals who specifically request that we do so or in the event that they have signed up to receive our free newsletters or have purchased one of our products. 28Factors.com collects personally identifying information from our users during online registration and online purchasing. Generally, this information includes name and e-mail address for registration to receive our free newsletters and name, postal address, and credit card information when purchasing our products. All of this information is provided to us by you.

(b) AUTOMATIC COLLECTION. We also collect and store information that is generated automatically as you navigate online through the Site. Our servers automatically recognize visitors’ domain names and IP addresses (the number assigned to computers on the Internet). No personal information about you is revealed in this process. The Site may also gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving the services we offer.

(c) COOKIES. From time to time, we may use the standard “cookies” feature of major browser applications that allows us to store a small piece of data on your computer about your visit to our Web site. Cookies help us learn which areas of our site are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at our Web site may be diminished and some features may not work as they were intended.

(d) BEACONS. The Sites also may use web beacons (single-pixel graphic files also known as “transparent GIFs”) to access cookies and to count users who visit the Site or open HTML-formatted email messages.

 

3. USE AND SHARING OF INFORMATION

3.1. WHAT DOES COMPANY DO WITH COLLECTED INFORMATION?

(a) PERSONAL INFORMATION. We use the information we collect from you while you are using the Sites in a variety of ways, including using the information to customize features and advertising that appear on the Sites. (c) USE OF COOKIES. We may use cookies to deliver content specific to your interests or for other purposes. Promotions or advertisements displayed on our site may contain cookies. We do not have access to or control over information collected by outside advertisers on our site.

(d) DISCLOSURE OF PERSONAL INFORMATION. We may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the edicts of the law or comply with legal process served on Company or its parent company, subsidiaries or affiliates, (2) protect and defend the rights or property of Company or the users of the Site, or (3) act under exigent circumstances to protect the safety of the public or users of the Site.

(e) SALE OF INFORMATION. In order to accommodate changes in our business, we may sell or buy portions of our company or other companies or assets, including the information collected through this Web site. In the unlikely event that we sell some or all of our assets, or one or more of our websites is acquired by another company, information about our users may be among the transferred assets.

(f) ACCESS TO INFORMATION. Unfortunately, we do not maintain any procedures for you to review or request changes to the information that we collect about you, except that you may request that we remove all information about you from our database by contacting us in accordance with Section 7.1 below.

 

4. STORING INFORMATION

Your information is stored at the list servers that deliver our Sites’ content and messaging. Your information can only be accessed by those who help manage those lists in order to deliver e-mail to those who would like to receive our Sites’ material.

 

5. SECURITY

The Site has security measures in place to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.

 

6. WEBSITE AREAS BEYOND COMPANY’S CONTROL

6.1. PUBLIC COMMENTS

Please keep in mind that whenever you voluntarily make your personal information available for viewing by third parties online – for example on message boards, web logs, through email, or in chat areas – that information can be seen, collected and used by others besides us. We cannot be responsible for any unauthorized third-party use of such information.

6.2. THIRD PARTY ADVERTISERS

Some of our third-party advertisers and ad servers that place and present advertising on the Sites also may collect information from you via cookies, web beacons or similar technologies. These third-party advertisers and ad servers may use the information they collect to help present their advertisements, to help measure and research the advertisements’ effectiveness, or for other purposes. The use and collection of your information by these third-party advertisers and ad servers is governed by the relevant third-party’s privacy policy and is not covered by our Privacy Policy. Indeed, the privacy policies of these third-party advertisers and ad servers may be different from ours. If you have any concerns about a third party’s use of cookies or web beacons or use of your information, you should visit that party’s website and review its privacy policy.

6.3. THIRD PARTY WEBSITES

The Sites also include links to other websites and provide access to products and services offered by third parties, whose privacy policies we do not control. When you access another website or purchase third-party products or services through the Sites, use of any information you provide is governed by the privacy policy of the operator of the site you are visiting or the provider of such products or services, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.

6.4. PROVIDER PARTNERS

We may also make some content, products and services available through our Sites through cooperative relationships with third-party providers, where the brands of our provider partner appear on the Sites in connection with such content, products and/or services. We may share with our provider partner any information you provide, or that is collected, in the course of visiting any pages that are made available in cooperation with our provider partner. In some cases, the provider partner may collect information from you directly, in which cases the privacy policy of our provider partner may apply to the provider partner’s use of your information. The privacy policy of our provider partners may differ from ours. If you have any questions regarding the privacy policy of one of our provider partners, you should contact the provider partner directly for more information.
